Central Vigilance Commissioner P. J. Thomas resigned today after the Supreme Court struck down his appointment for his alleged involvement in a corruption scandal and raised the issue of institutional integrity. Six months after the Kerala bureaucrat was named as head of the country's anti-corruption watchdog, the Supreme Court said the appointment by a high powered panel, did not exist in law.

An Apex court bench headed by Chief Justice S.H.Kapadia gave its verdict on a petition by the Centre for Public Interest Litigation challenging Thomas' appointment as CVC . Responding to the ruling, the Prime Minister Dr.Manmohan Singh said that he respects the court judgment and will speak in Parliament. On the other hand, the Law Minister M.Veerappa Moily said that the government is not in any position to say anything now as it has to study the verdict.

Briefing reporters in New Delhi today, Party Spokesperson Abhishek Manu Singhvi said that the judgement should not be politicised and there should not be any subjective interpretation. A fresh air strike has been launched on the opposition-held Libyan town of Brega a day after clashes between anti-government rebels and pro-regime fighters killed at least 12 people. Bombs were also dropped on a rebel position in the nearby town of Ajdabiyah, where people armed with rocket launchers, anti-tank aircraft guns and tanks had earlier shored up defences. The latest attacks come amid reports that Moamar Gaddafi and the president of the Arab League are considering a plan that would allow an international peacekeeping mission to mediate the crisis. The plan, put forward by Venezuelan president Hugo Chavez, would involve a commission from Latin America, Europe and the Middle East trying to reach a negotiated outcome between Mr Gaddafi and rebel forces. Arab League secretary-general Amre Moussa denied reports that he and Mr Gaddafi had agreed to the proposal.  The rebels repulsed a land and air offensive by Mr Gaddafi's forces on the eastern oil terminal of Brega, as the defiant leader warned foreign powers of another Vietnam if they intervened in the popular uprising against his 41-year rule. Speaking live on state television, Mr Gaddafi warned the battle will be very, very long if there is any intervention by foreign powers. The Arab League said it was against direct outside military intervention, but could enforce a no-fly zone in cooperation with the African Union.

In the on-going ICC Cricket World Cup,  Canada were 114 for the loss of 7 wickets in 37 overs  in reply to  the Pakistan total of 184 runs  when reports last came in. Electing to bat after winning the toss, Pakistan were all out for the moderate total with 7 overs yet to be bowled. Following yesterday's stellar performance by Ireland, less fancied Canada look to be steadying their efforts, to make a match of the gettable total of Pakistan today.

With Ireland having spearheaded the charge yesterday as they beat more fancied England chasing 3 hundred plus runs for the famous win, uncertainty of cricket looks certainly poised to surprise the world as the speculations have started evading popular conjecture at the world stage. The heroics however, could not be emulated by the Netherlands today who were bundled out by a quality bowling attack by South Africa for dishing out a crushing defeat. Though Canada looks more resolute today against Pakistan despite their earlier defeats against Srilanka and Zimbabwe. Restricting a good batting side of Pakistan to 184 with 7 more overs  yet to be bowled, Canada's efforts speak volumes of the turn around in the attitude and approach by the less fancied sides in the World Cup here on.

The Supreme Court today quashed the appointment of P J Thomas as Central Vigilance Commissioner. The Apex court upheld that  the recommendation made by the high-powered panel did not consider the relevant material and therefore its advice does not exist in law. 60-year-old Thomas, facing a corruption case in a Kerala court relating to a Palmolein import scam, resigned immediately after the apex court gave its awaited verdict, just six months after the former bureaucrat was appointed as the 14th CVC. A bench comprising Chief Justice S H Kapadia and justices K S Radhakrishnan and Swatantra Kumar said, the recommendations made on September 3, 2010 does not exist in law.  The bench  criticised the committee for not considering the relevant material including the pending criminal case against Mr. Thomas in the Palmolein import case and the recommendations of the DoPT between 2000-04 for initiating disciplinary proceedings against him. The apex court said that if the selection process adversely affects the institution then it is the duty of the authority not to recommend such persons and in the present case, this vital aspect was not taken into account by the Committee. The court rejected the contention of Mr. Thomas and the government that the appointment of the CVC cannot be brought under judicial review and said the legality of the recommendation can very much be reviewed by it. The bench also rejected the government's contention that vigilance clearance given by the CVC in 2008 was the basis for empanelment of Thomas as a candidate for the post of the CVC. While observing that the touchstone for the appointment of CVC is the institutional integrity as well as the personal integrity of the candidate, the court said in future, appointments should not be restricted to civil servants alone but people of impeccable integrity from other fields should also be considered. The bench said if there is a dissent note by any of the three members of the high-power panel, it has to be given with sufficient reasons and has to be considered by the majority. Further, the majority should also give reasons for their decision as this will lead to a transparent process in public interest and also inspire public confidence, it said. Adding the impartiality of the institution has to be maintained which is envisaged in the CVC Act. The court scrapped Thomas' appointment as CVC on a PIL by civil society, Center for Public Interest Litigation (CPIL) and retired bureaucrats and police officials, including former Chief Election Commissioner J M Lyngdoh, challenging his appointment in view of a criminal case pending against him in a Kerala court. Mr. Thomas was appointed CVC on September 7 the last year.

However, prices of fruit, milk and vegetables as a group continued to remain high. Food inflation stood at 11.49 per cent in the previous reporting week and at 21.62 per cent in the corresponding period a year ago.
