The Supreme Court today questioned the Central Government's decision to give a 4.5 per cent Sub-Quota for minorities on the basis of religion in Central Educational Institutions out of the 27 per cent reservation for OBCs. A Division Bench of the Court refused to stay the Andhra Pradesh High Court order quashing the decision. The bench before which the Human Resource Development Ministry placed the relevant and supporting documents, forming the basis for the Sub-Quota,  questioned whether classification can be made on the basis of religion. The Apex Court added that the Office Memorandum issued by the Government on the 22nd of December, 2011 did not have legislative support. The Additional Solicitor General, Gorab  Banerjee strongly pleaded in support of the Sub-Quota, but the Court upheld the Andhra Pradesh High Court order. It noted that there is ambiguity in the calculation for carving out the Sub-Quota from the OBC quota.

The NATO-led International Security Assistance Force, ISAF in Afghanistan has said that it will not carry out aerial operations in civilian residential areas of Afghanistan. A press release issued by the NATO coalition headquarters in Kabul last night said this has been decided in accordance with the understanding between President Hamid Karzai and the ISAF commander John R. Allen . The ISAF has also said that this measure is one more step in their efforts to protect the lives of Afghan civilians. Our correspondent has filed this report
"The figures of civilian casualty in Afghanistan show that the decade long war against the terror in the country has claimed the lives of more innocent civilians than the insurgents. Although, NATO forces take all precautions to minimise collateral damage during their operations, but the insurgents use the civilians in their residential areas as a shield. As per the understanding between the Afghan President and the ISAF Commander, use of ammunition in the NATO air operations in residential areas has been banned completely. The step will definitely help in saving lives of many innocent civilians. Rajendra Upadhyay, AIR NEWS, KABUL."

The Supreme Court today questioned Central Government's decision to give 4.5 per cent Sub-Quota for minorities on the basis of religion in Central Educational Institutions out of 27 per cent reservation for OBCs. While admitting the Centre's petition in the matter, a Division Bench of Justices K.S. Radhakrishnan and J.S. Khehar refused to stay the Andhra Pradesh High Court order quashing the decision. The Bench before which the Human Resource Development Ministry placed the relevant and supporting documents forming the basis for the Sub-Quota, questioned whether classification can be made on the basis of religion. The Apex Court added that Office Memorandum issued by the Government on the 22nd of December, 2011 did not have legislative support.  The Additional Solicitor General, Gorab Banerjee strongly pleaded in support of the Sub-Quota, but the Court upheld the Andhra Pradesh High Court order.  It noted that there is ambiguity in the calculation for carving out the sub-quota from the OBC quota.

The Supreme Court's refusal to stay the Andhra Pradesh High Court judgement that quashed the 4.5 per cent quota for minorities, will have its impact on the ongoing counselling for various IITs, as minorities will have no reserved seats for them in IITs. By introducing the 4.5 quota reservation exclusively for the minorities, the Centre had sought to provide admission to at least 325 minority candidates from the Muslim and converted Christian communities in the IITs.
